Contest Overview

Two Ways to Win

1. Submit photos of a room in your house that you think deserves a complete makeover:

Participants can submit one entry (up to four photos) of a room they would like Benjamin Moore to makeover using Natura paint products. Contestants can include a short story explaining why they most deserve a Natura Your World makeover.

US citizens who vote via the Natura Your Wolrd web site will determine ten finalists. A panel of expert judges from Benjamin Moore will choose a final winner who will be awarded a prize package worth $5,000 that includes a one hour color consultation, Natura paint, plus $4,500 in cash.

The winning makeover will be featured on benjaiminmoore.com.

The remaining nine semi-finalists win a $250 gift certificate for five gallons of Natura paint to complete their own makeover project. Participants who post photos of their room can also vote for their favorite entries, including their own. Doing so will automatically enter them into a random draw for a $500 cash prize.

2. Vote for the rooms that you think most deserve a complete Natura makeover:

Participants who do not post photos of their room are still eligible to vote for the rooms they think most deserve a complete Natura makeover. Voters are automatically entered into a random draw for a $500 cash prize. Participants can vote for their own photo submissions and can vote for as many rooms as they wish; however, they receive only one entry for the random draw.

Contest voting closes on November 30th.

Prizing

Post Photos & Win

Participants who post photos they believe are deserving of a room makeover, can win prizing worth $5,000:

The grand prize winner (selected from ten finalists by Benjamin Moore judges) will be awarded a prize package worth $5,000 that includes a one hour color consultation, Natura paint, plus $4,500 in cash.

• Total approximate retail value not to exceed ($5,000 USD), including all applicable taxes. The winner will have up to six months from the date of the draw to redeem their prize.

• The remaining nine runner-ups (selected by voters) will each be awarded $250 (five gallons) of Benjamin Moore Natura paint.

1. Eligibility
Benjamin Moore & Co. Natura® Your World Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States (including District of Columbia) eighteen (18) years of age or older at the time of participation. Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees, officers, directors of Benjamin Moore & Co. or other companies associated with the promotion of the Sweepstakes, as well as the immediate family (spouse, parents, siblings, and children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Sweepstakes is subject to federal, state and local laws and regulations.

2. Sponsor and Administrator

3. Agreement to Official Rules
Participation in the Sweepstakes constitutes an Entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. Sweepstakes Period
You may submit an Entry (as defined below) into the Sweepstakes between 12:00 AM ET on October 1, 2009 and 11:59:59 PM ET on November 16, 2009 (the “Sweepstakes Period”). Administrator is the official time keeper for the Sweepstakes.

5. To Enter
During the Sweepstakes Period, visit www.naturayourworld.com (the “Website”), follow the online instructions provided to submit up to four (4) photos of a room that you would like Benjamin Moore to makeover using Natura® paint products (the “Entry”). The Entry can include an optional short story of no more than 500 words that explains why you are the most deserving of a Natura® Your World Makeover. Submitting an Entry is free. Limit: one (1) Entry per person, per email address during the Sweepstakes Period. Entry must not have been entered in any other competition or violate the rights of other parties. Any Entry which the judges determine to be offensive or defamatory will be disqualified. Entrant assigns and transfers to Sponsor all rights, title and interest to the Entry. All Entries become the sole and exclusive property of the Sponsor and will not be returned. Subject to the Sponsor and Administrator’s discretion, entries will then be posted on the Website for voting by other registered Entrants as set forth below. All Entries must be received within the Sweepstakes Period. For purposes of these Official Rules, “receipt” of an Entry occurs when Sponsor’s servers record the Entry information. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules.

6. Selection of Sweepstakes Winners
There will be two (2) rounds of judging as set forth below:

Round 1: Between 12:00 AM ET on October 1, 2009 and 11:59 PM ET on November 30, 2009 (the “Voting Period”), eligible Entries will be posted on the Website for voting by other registered Entrants. Each registered Entrant will have the opportunity to view and vote for such Entries. All voting must be received during the Voting Period. Visitors will only be allowed to vote on each single Entry once during the Voting Period. Votes generated by script, macro, or other automated means or with the intent to impair the integrity of the voting process, as determined by Sponsor in its sole discretion, will be void. At the end of the Voting Period the number of votes for each Entry will be tabulated. The ten (10) Entries with the highest number of votes at the end of the Voting Period will advance to Round 2 (the “Finalists”). In the event of a tie in public voting, the tied Entries will be judged by a panel of Sponsor judges using the judging criteria below to determine which tied Entry or Entries (as applicable) will advance to Round 2. Each time a Visitor votes, he or she will receive one entry into the random drawing that will occur on or about December 14, 2009 amongst all eligible entries received.

Round 2: The Finalists will then be ranked by a panel of Benjamin Moore & Co. judges who will determine the winning Entry based on the criteria below. Judging will be based on the following criteria:essay (maximum 500 words) communicating the need for an improved interior look for the room (50%); photograph demonstrating the need for an improved interior look for the room (45%); quality of photography (5%).The  Finalist’s Entry with the highest score, as determined by the judges (at their discretion), will be declared the Grand Prize Winner subject to verification of eligibility and compliance with the terms of these rules.  In the event of a tie, the Grand Prize Winner will be determined based on highest score for the persuasiveness criterion as determined by Sponsor judges in its sole discretion). In the event of a further tie, the Entry involved in the tie having the highest vote (as determined by Sponsor’s judges in its sole discretion) will be deemed the Grand Prize Winner. The potential Grand Prize Winner will be contacted on our about [January 14, 2010]. Sponsor’s Judges decisions are final and binding on all matters regarding the Sweepstakes.

7. Verification of Potential Winners
Potential Winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential Grand Prize Winner will be required to sign and return to Sponsor, within seven (7) days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. If a potential Winner cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, the potential Winner forfeits prize. If the Grand Prize is forfeited, the next highest ranking finalist will be declared the Grand Prize Winner, subject to confirmation in accordance with these Official Rules.

8. Prizes: 
Grand Prize Winner: One (1) Grand Prize Winner of the Sweepstakes will receive: Five hundred ($500.00) in Natura® Paint, Four thousand Five Hundred dollars ($4,500) in cash, and a one hour color consultation. Approximate Retail Value (“ARV”) of the Grand Prize is $5,000.
Finalist Prize Winners: Nine (9) Finalist Prize Winners will each receive a certificate for Two Hundred and Fifty ($250) worth of Benjamin Moore’s Natura® paint. ARV of each prize is $250. 
Drawing Prize: One (1) Voter will randomly be selected to receive five hundred dollars ($500). ARV of the prize is $500.
For All Prizes: Odds of winning the Drawing Prize depend on the number of eligible Entries received. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with Prize receipt and/or use. Any and all guarantees and warranties are subject to the manufacturer’s terms and conditions, and Winner agrees to look solely to such entity for any such warranty or guarantee claim.

9. Ownership and Publicity Rights
Entries will be retained by Sponsor and will not be returned. By entering this Sweepstakes, Entrants waive any rights they may have in their submitted Entry and assign any and all rights, title and interest in and to Entries, including, without limitation, copyrights, to Sponsor. Each Entrant acknowledges and agrees that (i) Sponsor owns all Entries submitted during the Sweepstakes Period and Sponsor shall have the exclusive, unrestricted, perpetual, royalty-free, worldwide, freely-assignable and irrevocable right to use, edit, alter, copy, reproduce, license, sell, rent, disclose, display, publish, prepare derivative works from, perform, distribute, exhibit, broadcast, or otherwise exploit the contents of the Entries, in whole or in part, in any form, media or technology, now known or hereafter developed, including, without limitation, radio, broadcast television and the Internet, for any purpose whatsoever, including, but not limited to, advertising, promotion, entertainment and commercial purposes, without any payment to, or further authorization by, the Entrant. Although Sponsor shall have all such exclusive rights of ownership, it is not obligated to exercise these rights. Each Entrant further agrees that Sponsor and its designees have the unrestricted, irrevocable right, but not the obligation, to use the Entrant’s name, likeness, performance, hometown and state (collectively, with respect to each Entrant, a “Likeness”) in any and all media now existing or hereafter discovered or developed, for any and all purposes including, without limitation, advertising, promotion, entertainment and commercial purposes, without additional consideration to, or further authorization by, the Entrant unless prohibited by law.

10. General Conditions
In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prizes in a random drawing of all eligible Entrants at the time of the impairment. The Sponsor is only responsible for funding the Prizes set forth above. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. In the event of a dispute as to any registration, the authorized account holder of the e-mail address used to enter will be deemed to be the Entrant. The “authorized account holder” is the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted email address.

11. Release and Limitations of Liability
Except where prohibited, by registering and/or participating in the Sweepstakes, Entrants agree to release and hold harmless the Sponsor, its related companies, their respective officers, directors, employees, and agents, and anyone involved in the development or execution of this Sweepstakes (collectively, the “Released Parties”) from and against any and all claims, liability or cause of action which may occur in connection with participation in the Sweepstakes or the possession, acceptance, use or misuse of any Prize or part thereof, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes; (f) loss or damage to Entries; or (g) injury or damage to persons or property. The Released Parties do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability, and fitness for a particular purpose. Except where prohibited, Entrant agrees that: (a) any and all claims, judgments and awards allowed under the Official Rules shall be limited to actual out-of-pocket costs incurred, including costs associated with participation in the Sweepstakes but in no event attorneys’ fees; and (b) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.

12. Disputes
Entrants agree that the Sweepstakes is governed solely by the substantive laws of the State of New Jersey, without regard to its conflicts of law rules. Any claims arising out of or relating to this Sweepstakes or any prize may be brought only in a federal or state court in New Jersey. If any provisions of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

13. Privacy
Sponsor collects personal information from you when you enter the sweepstakes. The information collected is subject to the privacy policy of Sponsor at [http://www.benjaminmoore.com/privacy].

14. Results
